68 lawmakers file supplementary writ seeking house restoration; Supreme Court to hear case today

Kathmandu : A supplementary writ petition demanding the restoration of the House of Representatives, backed by the signatures of 68 lawmakers, has been scheduled for hearing at the Supreme Court today.

The petition, filed before the Constitutional Bench, is signed by 65 Nepali Congress lawmakers—eight of whom had earlier submitted a similar writ—along with three former lawmakers from other political parties.

Former Attorney General Khama Bahadur Khati lodged the petition on Tuesday through authorized representatives. According to the filing, the signatories include 57 Nepali Congress lawmakers, Goma Labh of the Janamat Party, Hasina Khatun of the Ashok Rai–led Janata Samajwadi Party (JSP), and independent lawmaker Yogendra Mandal.

The supplementary writ calls for an immediate halt to all activities related to the election of the House of Representatives. It argues that Prime Minister Sushila Karki’s appointment was unconstitutional and that any parliamentary elections conducted under her leadership would therefore lack legal validity.

“The parliamentary elections proposed by an unconstitutionally appointed prime minister and her government would be invalid. Hence, an order should be issued to restrain and stop all election-related activities,” the petition states.

Earlier, on December 9, eight Nepali Congress lawmakers had filed a writ petition seeking the restoration of the House, prompting the Constitutional Bench to issue a show-cause order on December 17.

In a separate development, 75 lawmakers from the CPN-UML had submitted a similar petition on November 26. During the preliminary hearing of that case, the Supreme Court directed the President, the Prime Minister, and other concerned authorities to submit written responses.

With the latest petition, the number of former lawmakers from the Nepali Congress, CPN-UML, and other parties seeking the restoration of the House of Representatives has now reached 143.
