Hearing on writ petition today against ‘Attorney General’ Kandel

Kathmandu — A hearing is scheduled for today on three writ petitions filed challenging the qualifications related to the appointment of Attorney General Dr. Narayan Datt Kandel. According to Supreme Court spokesperson Arjun Prasad Koirala, the three writ petitions opposing Dr. Kandel’s appointment were registered on Wednesday.

The petitions were filed by advocates including Madhav Basnet and Dipak Raj Joshi, who have raised questions regarding Dr. Kandel’s eligibility for the position. The petitions state that an unqualified individual has been appointed to the post of Attorney General. Prime Minister Balen Shah had appointed Dr. Kandel as Attorney General on Chaitra 22, 2082 (Nepali calendar).

As per constitutional provisions, the Prime Minister may appoint as Attorney General a person who is qualified to be appointed as a judge of the Supreme Court. The petitions further claim that Dr. Kandel does not possess the required experience, as the position mandates at least 15 years of continuous involvement in legal practice.
