Nepal Bar Association Voices Concern Over Government’s Recall of Ambassadors

Kathmandu : The Nepal Bar Association (NBA) has raised strong concern regarding the government’s recent move to recall ambassadors, despite the issue being sub judice at the Supreme Court.

In a press release issued on Wednesday, NBA General Secretary Kedar Prasad Koirala pointed out that the Supreme Court has already issued an interim order on the matter, which is still under consideration.

“In such a situation, the government’s decision to recall ambassadors and assign them to the Ministry of Foreign Affairs is deeply concerning,” the statement read. The NBA warned that any action undermining or disregarding a court order encourages arbitrariness and weakens respect for the rule of law. “We urge all parties to adhere strictly to the court’s directives and refrain from steps that could erode public trust in the judiciary,” it added.

While acknowledging that academic or legal debate over court decisions is legitimate, the association emphasized that compliance with judicial orders—whether direct or indirect—is a binding legal obligation. Citing constitutional provisions and Article 128(4) of the Constitution, the NBA stressed that any act producing outcomes contrary to court orders constitutes disrespect toward the judiciary and poses a threat to the principles of constitutionalism and judicial independence.
